The recent case of the family who appealed against Westminster’s decision to rehouse them in unsuitable accommodation raises an interesting point.
As we see from the details, an intitial appeal was made by the family to the Central London County Court but this was dismissed by Judge Bailey who said:
“the council was within its rights and had done nothing unlawful.”
This decision was flawed and the appeal was upheld in the Court of Appeal.
We have it on very good authority that all may not be as it seems vis-à-vis many of the judgments by the Central London County Court, which have found in favour of Westminster Council
